Information notice under Italian L.D. 196/2003 dated June 30th 2003 “Personal data protection code”
Dear visitors, as required by art. 13 of Italian Legislative Decree no. 196 of June 30th 2003, “Personal Data protection code” which regulates the protection of persons and other subjects concerning the processing¹ of their personal data², Euronda S.p.A., VAT no. 00595740242, with registered office in Montecchio Precalcino (VI), Via dell’Artigianato no. 7, in its capacity as Data Controller of such processing procedures, hereby informs you as follows.
1. Processing Methods and Purposes
1.a) Personal data are collected during the registration process with the www.euronda.com website. The personal data collected by Euronda S.p.A. shall be processed and retained by the same at its registered address so as to: 1. comply with all obligations concerning legal, fiscal and accounting standard requirements;
2. perform all strictly preliminary operations and/or related to the finalising of contractual relationships with Euronda S.p.A. following the order you submitted to purchase products offered by Euronda S.p.A., and all operations related to the provision of the agreed services by Euronda S.p.A., including mailing of our catalogues and/sales promotions.
3. send by standard and/or electronic mail, SMS, MMS, FAX, commercial communications or advertising and/or promotional materials;
4. provide telephone information on commercial offers or advertising and/or promotional materials;
1.b) In compliance to what provided by art. 11 of this Italian Code, our company processes all personal data using correct, licit and transparent principles and methods regarding the protection of privacy and the rights of the subjects to whom the data refers, will not involve use of your sensitive and judicial data and will be performed using means, including electronic and/or automated systems in a manner that guarantees the security and confidentiality of all such data and prevent any amendment, erasure and destruction of the data, unauthorised access or unauthorised processing which does not comply with the scope and purpose of the collection, with logics which are strictly related to the aforementioned purposes and for a period of time necessary to achieve the purposes for which the data was collected or subsequently processed. The information acquired by Euronda S.p.A. is also protected by state-of-the-art technological security measures and suitable procedures.
2. Conferral of data
2.a) Conferral of data by means of compiling the registration form and accepting our website user terms and conditions, express the consent of Customers to the processing of their personal data for the purposes indicated in the section above. Such data is deemed mandatory as it allows you to use and access the website correctly and exploit all required services. Failure to provide, or revocation of such consent will interrupt all such relationship.
2.b) Providing personal data for the purposes indicated in point 1a) section 3 above is optional. If you do not wish to receive any further commercial and/or advertising communications from Euronda S.p.A. or any third parties referred to in section 3 below (Methods of communication and dissemination of data), please send an express request to Euronda S.p.A. at the above address.
Consent for your personal data to be processed for contractual and legal purposes is not required.
3. Methods of Communication and Dissemination of Data:
3.a) Pursuant to the aforementioned purposes, your personal data may be communicated respectively: to the competent Public Authorities and Administration to allow Euronda S.p.A. to comply with all its legal obligations; and other subjects that intervene in Euronda S.p.A.’s corporate processes. (such as, for instance, banking institutions, postal services, shipping agents and other third-parties who provide specific services on our behalf and act as autonomous entities) to whom such communication is necessary in order to pursue such purposes and improve the services provided.
3.b) Your data can also be communicated to designated officers and subjects appointed by Euronda S.p.A. to perform such processing operations: to Euronda S.p.A. employees (such as, for instance, management staff, administration, sales, purchasing and technical department staff); to outsiders, Italian and/or foreigners, who provide specific activities or services on behalf of Euronda S.p.A. and in order to provide such services, have been appointed by Euronda S.p.A. as designated officers in charge of such processing operations (such as, for instance, sales network agents, consultants and advisers, technicians who perform the installation and maintenance of Euronda products.)
4. Rights of the Data Subject
We would also like to inform you that you are granted the rights foreseen by Art.7 of Italian L.D. n. 196/2003, provided below in its entirety for your convenience, which you may exercise at any moment in time including, in particular, the right to request confirmation as to whether or not your personal data exits, and to be informed on the content and origin, receive communications in an intelligible form of the same, receive information on the logic, scope and purpose of the processing procedures used, request erasure, rectification, updating and integration, object in whole or in part, on legitimate grounds to the processing of the same, sending the relative request to Euronda S.p.A. via the website or directly to the company’s registered office.
5. Data Controller
The Data Controller is identified as Euronda S.p.A., VAT no. 00595740242 with registered office in 36030 Montecchio Precalcino (VI), Via dell’Artigianato n. 7. The updated list of names and contact details of designated officers is available at the Euronda S.p.A. offices.
1 “processing” shall mean any operation, or set of operations, carried out with or without the help of electronic or automated means, concerning the collection, recording, organisation, keeping, interrogation, elaboration, modification, selection, retrieval, comparison, utilization, interconnection, blocking, communication, dissemination, erasure and destruction of data, whether the latter are contained or not in a data bank;
2 “personal data” shall mean any information relating to natural or legal persons, bodies or associations that are or can be identified, even indirectly, by reference to any other information including a personal identification number;
Art. 7 Italian L.D. 196/03 – Rights to access personal data and other rights:
1. The data subject has the right to request confirmation as to whether or not personal data concerning them exists, regardless of their being already recorded, and communication of such data in an intelligible form.
2. In particular, the Data Subject has the right to obtain indications on:
a. the source of the personal data;
b. the purposes and methods of the processing;
c. the logic applied to processing if the same is carried out with the use of electronic means;
d. the personal data of the Data Controller, the persons in charge and the designated representatives pursuant to Art.5 paragraph 2;
3. The Data Subject has the right to obtain indications on :
a. updating, rectification or, where interested therein, integration of the data;
b. erasure, anonymisation or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
c. certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
4. The data subject is entitled to oppose, totally or partially:
a. on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b. to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
